Mother of Payne kids files suit over deaths

The mother of two children who died in the custody of their father has filed a wrongful death lawsuit against Child Protective Services asking for unspecified damages.

This is crazy! She should also be charged with some form of child neglect. Had her children been her priority they would probably still be alive.

Didn't she give the kids to him originally when she wasn't supposed to? Considering her history as well, isn't this a Catch 22 for CPS? The lesser of two evils??

Didn't this same person file a wrongful death suit late in 2007, then got arrested for drug possession and now she is filing again ?? Did not even report her kids missing !! She must be having some severe withdrawals.

Your correct Dan(#3) All she wants to do is point her finger(blame) someone else, when in fact she is as much to blame for her own neglegence. All I feel is she is out to get a big fat check! At this time we're only hearing part of this story, I believe she has some skeletons in her closet....we will see. I'm just sickin' to hear how this innocent babies died! R.I.P. lil' ones.

The last story I read stated she was arrested during a drug bust last fall. The story also stated she has had another baby that (SURPRISE) had been removed from her by CPS.

I feel for these children, but she should NOT recveive any money.

Ok we all know she is a POS..gave her children to that monster father, busted for meth herself..... but, what kind of scumbag files a lawsuit in her behalf. I hope she gets laughed out of court and comment #1 I agree 100% she should be charged for a crime too. The CPS worker should not be working for CPS anymore as far as my opinion OR the supervisor in charge. This is sick those poor babies die a horrific death and she is looking for monetary compensation for more meth no douby.

I see CPS is still at it...
It would seem to me there are kidnapped children in State custody who are being raped, abused, and murdered that need to be checked on.

Former Child Protective Services case manager Armando Acuna was investigated by police for an inappropriate romantic relationship with one of his teen-age charges in 2003.
But Acuna, now 56, was never charged, and voluntarily resigned from CPS without ever being disciplined.
His story is one of several cases coming to light in which CPS caseworkers' personal actions appear to have been in conflict with their professional responsibility.

Startling new information on a supervisor for child protective services. News 4 has learned from multiple sources, and a confidential document, that there's been a "relationship" between a Tucson CPS supervisor and one of her former clients.
The client is a convicted child abuser.
The document, dated December 20, 2004, describes abuse earlier that month of a 4 year old by his father.
Daycare workers noticed the boy had 9 or 10 bright red welts on his right hip and below his right buttocks." The police were called, and an investigation was conducted. The father, eventually, pled guilty to child abuse.
But there's more to this story. The convicted child abuser began a romantic relationship with a CPS supervisor in her office 10 months before the abuse occurred.
And even before the relationship began, that supervisor was the family's case manager from December 2000 to October of 2002.
The document details abusive incidents dating back 10-years. Here are just some of the details:
In April of 1995, the document says, "The father punched [his daughter] in the face when the parents were arguing."
September of 2000, "The children would go to neighbors asking for food" and that there was "no formula for [the baby]." All three kids were then removed from the home, but returned in 2002.
August of 2002, another report is filed. It says the man's daughter "went to school with bruising and broken capillaries on the right side and left sides of her face." Despite the substantiated report that the father slapped the daughter, the kids remained with their father.

I think most of us can agree that the CPS system is broke. But giving money to a neglectful mother who probably carries as much blame as anyone else in this is not going to solve the problem. From what I understand (and I could be wrong, it happens frequently), the funding for CPS is lacking but the caseload is quite substantial. I'm guessing that with the money we pay to CPS workers, we probably don't get the "cream of the crop" for employees. Very sad.

Police have already unearthed three cellars under a trap door in the former children's home, Haut de la Garenne.
Statements from victims and whistleblowers taken over the last 48 hours include details of how staff would invite friends from outside to come for "abuse parties" where children were drugged, raped and beaten. And horrified locals told how they had seen staff dragging children across the fields late at night. Some were never seen again.
Deputy chief police officer for Jersey Lenny Harper said: "There are rumours and anecdotal evidence of bodies being buried in the grounds and we've been told that remains were buried in the grass banks nearby.

Police fear they are on the verge of uncovering another body at a children's care home in Jersey after breaking into a cellar and discovering a second secret chamber.

Detectives investigating claims of systematic child abuse over the last six decades on the island have spent three days concentrating on the area after a sniffer dog indicated he had picked up a scent. Alleged victims in the inquiry told police the cellar was a place where they were abused and described the lay-out in detail.
Haut de la Garenne, which was converted into a youth hostel four years ago, is at the centre of one of Britain's biggest child abuse scandals.
More than 160 alleged victims of sexual, physical and psychological abuse have come forward since police publicly launched their investigation into abuse on the island last November.
The inquiry, which has drawn up a list of 40 suspects, intensified last weekend with the discovery of human remains and now more than 200 people have contacted the authorities. There are fears that as many as seven bodies may be found.
Builders working on the refurbishment of the property in 2004 claimed they had found shackles and canes in a cellar.
